The CRA has released the following statement regarding the need for an employment policy in rental operations:

"If you have employees, you have employment policies. But, if those policies are
not recorded in writing, what should be clear understandings between you and
your staff may be just vague assumptions. Your employees could have very
different impressions than you have of where they stand, what they are entitled
to and what their obligations are. A written manual provides everyone with the
same set of rules to follow. Operating a business today without a policy manual
is like playing a hockey game without a rule book.

"A good employee policy manual distributed to your staff is a necessity in
today's work and social environment. Employment laws and regulations are
becoming increasingly complex and demanding, emphasizing employee rights and
often having little regard for the situation of smaller employers.

"Publishing and recording your employment policies can be extremely helpful in
cases of litigation or arbitration involving employees, former employees or
third parties; although, of course, it cannot guarantee a favorable outcome or
prevent the possibility of legal complications with employees. It's a way for
you to show that you have emphatic policies against discrimination and harassment,
for example. It may reduce the risk of liability for illegal acts of your
employees when such activity is explicitly prohibited in your published
policy manual.

"Employees cannot excuse wrongful or harmful conduct by claiming that they did
not know about related company policy. You can more easily establish that your
company is not to blame if employees violate company policy and harm other employees
or third parties.

"Unsatisfactory or undesirable employees can be discharged with less risk of
expensive consequences or legal problems, because your written policy manual
specifies causes for dismissal and a clear disciplinary procedure. Requests for
exceptions, special consideration and excessive or unreasonable demands from
employees are discouraged and easier to decline because the limits on
employee entitlements can be clearly spelled out.

"Your supervisors and line management become more effective because routine,
everyday decisions can be based on policies set out in the manual, relieving
management from being consulted as often. Management authority can be
decentralized because the manual sets out guidelines, within which lower-level
supervisors can safely operate, reducing the risk of costly or embarrassing
mistakes resulting from policies made 'on the spot.'

"A thorough, up-to-date policy manual helps fill in gaps in your existing
policies, corrects weaknesses and addresses areas of possible vulnerability.
Your business will be seen as professionally managed and contemporary with
well-organized and properly run personnel functions. If you have lenders or
investors, they will be reassured that your exposure to unexpected employment-related
liability is low."
